Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Kalibrate mobile application (the "App") operated by Training State, LLC ("us," "we," or "our").

Your access to and use of the App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the App.

1. Subscriptions

Some parts of the App are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your online account management page on the App Store.

A valid payment method is required to process the payment for your Subscription. All purchases are processed through the Apple App Store.

2. Introductory Pro Access

We may, at our sole discretion, offer eligible users a limited introductory period of Pro access within the App (the "Introductory Access Period").

The Introductory Access Period is not a StoreKit subscription free trial. It does not require billing information to begin, and it does not automatically convert into a paid subscription at the end of the period.

After the Introductory Access Period ends, the App reverts to its free tier unless you separately purchase a monthly subscription, yearly subscription, or lifetime access through the Apple App Store.

At any time and without notice, we reserve the right to modify, limit, or cancel the Introductory Access Period, subject to applicable law.

3. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Training State, LLC and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

4. Disclaimer

The App is provided for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

6. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Use within the App.
